29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  a) At the facility located at 650 Oak Park Avenue, Fond du Lac, WI 54935, the employer did not develop or implement a written hazard communication program when plating employees worked with hazardous chemicals in the workplace such as, but not limited to hydrofluoric acid, nitric acid, nickel sulfate, and sulfuric acid.  All provisions of 29 CFR 1910.1200(e) through (h) must be contained in a written hazard communication program. Key elements include, but are not limited to the following:  1) Complete collection of SDS; 2)  Container labeling; 3)  Employee information and training.

29 CFR  1910.1200(f)(6): Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either:  (i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  a) At the facility located at 650 Oak Park Avenue, Fond du Lac, WI 54935, in the Plating Area, the employer did not ensure that containers of hazardous chemicals were labeled, tagged or marked, with the identity and/or hazards of its contents, exposing employees to chemical hazards in the following instances:  a) Two hot acid tanks containing hydrofluoric acid, nitric acid, and sulfuric acid;  b) Two tanks containing nitric acid;  c) One partial plastic drum containing hydrofluoric acid and nitric acid; d) Two plastic drums containing used nitric; e) Four strike tanks containing nickel carbonate and sulfuric acid; f) Dummy plate tank containing sulfuric acid.

Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.  a) At the facility located at 650 Oak Park Avenue, Fond du Lac, WI 54935, the employer did not ensure that safety data sheets (SDSs) for hydrofluoric acid and nickel sulfate were maintained. The employer maintained a copy of the MSDS for hydrofluoric acid and nickel sulfate for employee use.

29 CFR  1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  a) At the facility located at 650 Oak Park Avenue, Fond du Lac, WI 54935, the employer did not certify in writing that a hazard assessment had been performed to evaluate the workplace hazards and the PPE those hazards necessitated when employees were exposed to chemical hazards, such as but not limited to hydrochloric acid, nitric acid, nickel sulfate, and sulfuric acid.
