29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about November 9, 2021, employees were conducting removal of drip flashing on a residential building in Mequon Wisconsin, utilized a ladder to access the roof that did not extend at least (3) feet above the eve. This exposed employees to a fall hazard of approximately 11 feet to the lower level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) On or about November 9, 2021, employees were conducting removal of drip flashing on a residential building in Mequon Wisconsin, without the use of a fall protection system. This exposed employees to a fall hazard of approximately 11 feet to the lower level. Twin Pines Home Improvement LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1534174, citation number 1, item number 1 and was affirmed as a final order on July 13, 2021, with respect to a workplace located at 10710 N. Briarwood Court in Mequon, WI 53092.
