29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about November 9, 2021, at the facility located at 302 East Water Street, Cascade, Wisconsin, the employer had not developed and implemented a written energy control program for employees engaged in servicing and maintenance activities.    An effective written energy control program includes, but is not limited to, the following: 1) Energy control procedures 2) Affected employee training consisting of the purpose and use of the energy control procedure 3) Authorized employee training consisting of recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. 4) Periodic inspections to ensure employees are performing energy control procedures correctly and the procedures are accurate.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use.  Reference: ANSI Z358.1 Emergency Eyewash and Shower Standard  On or about November 19, 2021, at the facility located at 302 East Water Street, Cascade, Wisconsin, employees working in the Packaging Department were exposed to injurious corrosive materials and was not provided a means of flushing the eyes or body within the work area for immediate use.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about November 19, 2021, at the facility located at 302 East Water Street, Cascade, Wisconsin, the employer failed to perform an employee performance evaluation for a powered industrial truck operator after formal training was conducted.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: At a facility located at 206 Charles Street, Oconto, WI 54153; the employer did not implement and maintain a written hazard communication program when employees worked with hazardous chemicals such as, but not limited to fiberglass, resins, hardeners, primers, solvents, and putty/fillers. All provisions of 29 CFR 1910.1200(e) through (h) must be contained in a written hazard communication program.   On or about November 9, 2021, at the facility located at 302 East Water Street, Cascade, Wisconsin, the employer had not developed and implemented a written hazard communication program for employees exposed to hazardous chemicals.
