29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 3rd Floor: Employees were observed installing railings on 3rd floor balconies and were not provided with fall protection and were exposed to a 19 foot - 4 ?" fall hazard to ground, on or about November 8, 2021. b) 4th Floor: An employee was observed installing railings on 4th floor balconies and was not provided with fall protection and was exposed to a 29 foot - 0 ?" fall hazard to ground, on or about November 8, 2021. c) 5th Floor: Employees were observed installing railings on a 5th floor balcony and were not provided with fall protection and were exposed to a 38 foot - 8 ?" fall hazard to ground below, on or about November 8, 2021. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Job Site: Employees were not trained in appropriate fall protection methods to avoid hazards associated with elevated work areas, such as but not limited to, apartment balconies, on or about November 8, 2021.
