OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the crushing hazards associated with lifting a car with a two pole car lift with manually overridden safety devices. (a) Used Car Shop, Bay 1: On or about November 18, 2021 and times prior, an employee used Mohawk Resources LTD two post car lift (Model A-7) that had one of the lift post mechanical safeties overridden. (b) Used Car Shop, Bay 2: On or about November 18, 2021 and times prior, an employee used a Mohawk Resources LTD two post car lift (Model A-7) that had one of the lift post mechanical safeties broken and overridden. (c) Used Car Shop, Bay 3: On or about November 18, 2021 and times prior, employees had a Mohawk Resources LTD two post car lift (Model A-7) available for use that had both of the lift post mechanical safeties overridden. (d) Used Car Shop, Bay 4: On or about November 18, 2021 and times prior, employees had a Mohawk Resources LTD two post car lift (Model A-7) available for use that had one of the lift post mechanical safeties overridden. (e) Used Car Shop, Bay 5: On or about November 18, 2021 and times prior, an employee used Mohawk Resources LTD two post car lift (Model A-7) that had one of the lift post mechanical safeties overridden.
