29 CFR 1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a) Open Pathway Construction, LLC at 601 South Highline Place, Sioux Falls, SD 57110 : On or about and at times prior to November 9, 2021, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Employees were exposed to fall hazards as a result of conducting framing activities without the use of a fall protection system, fall hazards associated with improper use of ladders, and lack of training. This condition exposed employees to a variety of hazards identified on site.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a)Open Pathway Construction, LLC at 601 South Highline Place, Sioux Falls, SD 57110 : On or about and at times prior to November 9, 2021, the exposing employer did not ensure that employees were protected from falls while conducting framing operations on a commercial property.  Employees were conducting framing operations from the top plates of the exterior and interior walls of the commercial property with no fall protection system in place.  This condition exposed subcontracted employees to fall hazards greater than 11 feet.

This condition exposed employees to fall hazards greater than 11 feet.
