29 CFR 1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a) Thompson Excavation, LTD at a worksite located at 8617 Taylor Road, Reynoldsburg, Ohio 43068: On or preceding June November 17, 2021, the employer did not maintain a compliant safety program such as but not limited to Excavation and Trenching. While an employee was operating a excavator, contact between the excavator and the line exposed the employee to a 20 kV electrical contact hazard.

29 CFR 1926.600(a)(6): All equipment covered by this subpart shall comply with the following requirements when working or being moved in the vicinity of power lines or energized transmitters, except where electrical distribution and transmission lines have been deenergized and visibly grounded at point of work or where insulating barriers, not a part of or an attachment to the equipment or machinery, have been erected to prevent physical contact with the lines: 29 CFR 1926.600(a)(6)(i):For lines rated 50 kV or below, minimum clearance between the lines and any part of the crane or load shall be 10 feet. a) Thompson Excavation, LTD at a worksite located at 8617 Taylor Road, Reynoldsburg, Ohio 43068: On or preceding June November 17, 2021, the employer did not ensure an employee who was operating an excavator maintained a 10 foot clearance from the excavator and an overhead electrical line. Contact between the excavator and the line exposed the employee to a 20 kV electrical contact hazard.
