(a) On or about November 19, 2021, at the worksite located at 4304 S. Beaumont Road, Kansasville WI, the employer did not ensure a safe means of access was provided from the elevated platform that was part of the fueling station to the top of the fuel truck, thereby exposing workers to fall hazards.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) On or about November 19, 2021, at the worksite located at 4304 S. Beaumont Road, Kansasville WI, the employer did not ensure each employee on a walking working surface with an unprotected side or edge 4 feet or more above a lower level was protected by fall protection. Employees will access an elevated platform associated with the fueling station in order to access the top of trucks for refueling operations. This elevated platform did not have adequate fall protection, thereby exposing workers to fall hazards.

29 CFR 1910.106(f)(3)(iv)(a): Bonding facilities for protection against static sparks during the loading of tank vehicles through open domes shall be provided: (1) Where Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), are loaded, or (2) Where Category 3 flammable liquids with a flashpoint at or above 100 �F (37.8 �C) or Category 4 flammable liquids are loaded into vehicles which may contain vapors from previous cargoes of Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C). (a) On or about November 19, 2021, at the worksite located at 4304 S. Beaumont Road, Kansasville WI, the employer did not ensure bonding devices were utilized for the safe transfer of fuels, thereby exposing employee to burn hazards.
