29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  A.) On or about November 19, 2021 employees were not adequately trained in the recognition and avoidance of hazards associated with trenching and excavating in that they were working in a 15' deep trench without cave in protection and adequate means of access and egress.

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  A.) On November 19, 2021 employees were exposed to falling objects in that an employee in a 15' deep trench without sidewall protection and a spoil pile closer than 2' was not wearing head protection.

29 CFR  1926.651(j)(2):Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  A.) On November 19, 2021 employees were exposed to falling dirt and debris in that a spoils pile was not at least 2' from the edge of the unprotected trench or restrained by other means while employees were in the trench.

29 CFR  1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations shall be in written form at the jobsite during construction of the protective system. After that time this data may be stored off the jobsite, but a copy shall be made available to the Secretary upon request.   A.) On November 19, 2021 and days prior the employer did not have the tabulated data information on site or readily available for review for four GME brand trench shields that were on site.

A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  A.) On November 19, 2021 employees were working in an excavation measured to be 15' in depth without adequate means of access or egress. 29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: -Excavations are made entirely in stable rock; or -Excavations are less than 5 feet (1.52m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.  A.) On or about November 19, 2021 employees were exposed to cave in hazards in that they were working in an unprotected trench that was excavated in type "B" soil and measured to be 15' in depth.
