On or about November 17, 2021, the employer did not ensure that fire extinguishers were readily accessible to employees at the bakery facility.     Instance A   A fire extinguisher was not mounted and accessible to the employees in the oven room. Bakery tray racks were stored at the front of the fire extinguisher impeding access to the fire extinguisher.     Instance B   A fire extinguisher was not accessible to the employees by the loading dock entrance. Wood pallets were stored at the front of the fire extinguisher, restricting access to the fire extinguisher.     Instance C  A fire extinguisher was not readily accessible to employees on the production floor. Bakery tray racks were stored at the front of the fire extinguisher impeding access to the fire extinguisher.

The inspection tag shows it was lasted inspected in July 2020.

The employer provided fire extinguishers and required the employees to use the fire extinguisher to fight fires.

29 CFR  1910.263(l)(8)(iii):A main disconnect switch or circuit breaker shall be provided. This switch or circuit breaker shall be so located that it can be reached quickly and safely. The main switch or circuit breaker shall have provisions for locking it in the open position if any work on the electrical equipment or inside the oven must be performed.  a) On or about November 17, 2021, at the bakery, the oven switch and breaker were not located such that they could be reached quickly and safely. A fire extinguisher, a vacuum machine, and bakery tray racks were stored at the front of electrical panels in the baking room, blocking access to the breaker and switch.

On or about November 17, 2021, at the bakery, insufficient access and working space were not provided and maintained to permit ready and safe operation and maintenance of electrical panels. Instance A At the entrance of the oven room, wall-mounted floating shelves, plastic crates, and employee personal items were stored at the front of electrical panels.  Instance B At the production floor, a portable ladder and cabinet were stored at the front electrical panels.

29 CFR 1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:  a) At the Santos Bakery, the employer did not develop and implement a written hazard communication program for employees who are exposed to hazardous chemicals such as, but not limited to, WD-40 which contains aliphatic hydrocarbons and carbon dioxide, Pyroil brake cleaner which contains tetrachloroethylene and carbon dioxide, and Resolve Five which contains sodium hydroxide and diethylene glycol monobutyl ether. The chemicals are used to maintain baking machines, the company's trucks, and cleaning.  The violation occurred on or about 11/17/2021.
