The scaffold was not fully planked and had gaps of greater than 1 inch.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) On or before November 17, 2021, and at times prior, the employer did not ensure that scaffold and scaffold components were inspected for visible defects by a competent person before each work shift. Employees were exposed to fall hazards greater than 10 feet while working on the platform of a scaffold with space between plans and uprights greater tan 1 inch, missing guardrails and missing mid rails.

29 CFR 1926.451(g)(4)(xv): The employer did not install crossbracing to be acceptable in place of a midrail when the crossing point of two braces is between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The end points at each upright shall be no more than 48 inches (1.3 m) apart: a) On or before November 17, 2021, and at times prior, employees were not protected by guardrail systems while working on a supported scaffold of approximately 30 feet high. Cross braces were used as guardrail systems on the scaffold without a mid rail installed. The height of the cross brace crossing points were 48 inches high. This condition exposed employees to fall hazards of more than 10 feet.
