OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to being struck by the excavator bucket. Location: Worksite On or about November 19, 2021, employees were exposed to struck-by, caught between and amputation hazards while working where the employer did not ensured the excavator bucket manual safety pin was engaged. Actual Employee Injury: On November 19, 2021, an employee suffered a finger amputation on the right hand after being struck-by a falling excavator bucket that had not been secured with the manual safety pin.
