29 CFR  1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a)  Fairacres Manor, Inc., at 1700 18th Avenue, Greeley, CO:  On or about December 30,2021, employees were exposed to a potential respiratory illness in that, the employer failed to provide a medical evaluation to employees required to wear Honeywell: model DC365 N95 and/or 3M: N95 filtering facepiece respirators when caring for residents who were placed in quarantine during a COVID outbreak at the facility.

29 CFR  1910.134(e)(3)(i):  The employer did not provide a follow-up medical examination for employees who gave a positive response to any question among questions 1 through 8 in Section 2, Part A of Appendix C, or whose initial medical evaluation demonstrated a need for a follow-up medical examination:  a)  Fairacres Manor, Inc., at 1700 18th Avenue, Greeley, CO:  On or about December 30, 2021, follow-up medical examinations were not given/provided to employees who gave a positive response to questions 1 through 8 in Section 2, Part A of Appendix C or whose initial medical evaluation demonstrated a need for a follow-up medical examination. Employees tasked with providing healthcare services to/for residents placed in quarantine during a COVID outbreak at the facility were required to wear N95 filtering facepiece respirators.  Approximately eleven employees gave positive response to questions 1 through 8 in Section 2, Part A of Appendix C.  These employees did not receive a follow-up medical examination and were thus potentially exposed  respiratory illnesses.

29 CFR  1910.134(f)(2):  Employees using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used:  a)  Fairacres Manor, Inc., at 1700 18th Avenue, Greeley, CO:  On or about December 30, 2021, employees mandated to wear tight-fitting facepiece respirators when caring for residents in isolation and during a COVID outbreak at the facility, were not fit tested with the same respirator they used while caring for residents; thus, potentially exposing employees to a SARS-CoV-2 virus hazard.

29 CFR  1904.29(b)(8):  The employer classified other types of injuries and illnesses as privacy concern cases:  (a)  Fairacres Manor, Inc., at 1700 18th Avenue, Greeley, CO:  On or about December 01, 2021, the employer entered eleven days away from work, recordable illnesses involving COVID 19, as "privacy cases" on the 2021 OSHA 300 Log.  COVID cases are not classified in 29 CFR 1904.29(b)(7) as privacy concern cases.

29 CFR  1910.134(m)(2)(i)(E):  The employer did not establish a record of the qualitative and quantitative fit tests administered to an employee which included the pass/fail results for qualitative fit tests or the fit factor and strip chart recording or other recording of the test results for quantitative fit tests:  (a)  Fairacres Manor, Inc., at 1700 18th Avenue, Greeley, CO:  On or about December 01, 2021, documents used to record the results of qualitative fit tests, administered to employees to include the pass/fail results of said test; were not developed and/or maintained by the employer. Employees, required to wear N95 filtering facepiece respirators when providing healthcare services to residents who have been placed in isolation because of suspected SARS-CoV-2 virus infection or positive COVID exposure did not have respirator fit test records that included pass or fail results, thus potentially exposing employees to a SARS-CoV-2 virus hazard.
