Employees were exposed to serious caught-in, crushing and or struck-by injuries, when operating including but not limited to the CAT forklift Model # GP30N, Serial # AT13G02921, in that the forklift operators had not completed a competent training program.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Warehouse: Employees had not received training on the chemicals they were working with at the time of their initial assignment, such as, but not limited to the DO-IT All Purpose and Premium Paints, which contain acetone, xylene and are highly flammable. which is harmful to the lungs and eyes if used without PPE.(Personal Protective Equipment) b) Paint Mixing Room : Employees had not received training on the chemicals they were working with at the time of their initial assignment, such as, but not limited to GEOSHADES Colorant which contains Titanium Dioxide - 2B - Talc - 3 - Amorphous Silica. which is harmful to the lungs and eyes if used without PPE.(Personal Protective Equipment) c) Retail Store : Employees had not received training on the chemicals they were working with at the time of their initial assignment, such as, but not limited to Sunny Side brand Acetone which is highly flammable and harmful to skin and eyes if used without proper PPE. (Personal Protective Equipment)
