29 CFR 1910.147(c)(4)(i): Procedures were not utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) Conveyor Line 1 at the Depositor: On or about November 24, 2021, lockout procedures were not utilized to protect employees from the pinch point and amputation hazard that existed when employees attempted to clean excess product from in and around the exposed pinch point hazard, a process of routine machine maintenance being performed while the machine was energized, and in operation. In the alterative: 29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. a) Conveyor Line 1 at the Depositor: On or about November 24, 2021, adequate guarding was not provided to protect employees from the pinch point and amputation hazard that existed when the machine cycled, and as employees attempted to clean excess product from in and around the exposed pinch point hazard, a process of routine machine maintenance being performed while the machine was energized, and in operation.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, and flying chips. a) Conveyor Line 1, to the left of Depositor: On or about November 24, 2021, adequate guarding was not provided, or had been removed from the East side of the conveyor line exposing employees to pinch point, amputation, and crushing hazards when the conveyor was in operation and conveying product.
