29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition:  On or before November 23, 2021, and at least two weeks prior, employees who worked in the sawmill facility where 2x4 (studs) are manufactured, were exposed to combustible and explosive hazards generated by Class II combustible dust that was allowed to accumulated more than 1/32 inch on surface areas such as ceiling rafters, electrical conduit, lighting fixtures, electrical disconnect boxes, horizontal wall beams, stairs, saw machinery and other equipment.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  On or before November 23, 2021, periodic inspections of the company's energy control procedures were not completed at least annually to ensure that any changes to the existing procedures and/or deficiencies were identified. The lack of inspections for lockout procedures applies to the following equipment:  a) The lockout procedure for the cut-up and sawmill line was missing the following: the purpose and scope of the procedure, types and magnitude of the energy sources to be render safe, and the steps to take to ensure that lockout was successful before the start of any work activities.   b)  The lockout procedure for the planer line was missing the following: the purpose and scope of the procedure, types and magnitude of the energy sources to be render safe, and the steps to take to ensure that lockout was successful before the start of any work activities  These conditions exposed employees to caught in/caught by, entanglement and amputation hazards from rotating parts.

29 CFR  1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy for energy isolation and control:  The employer failed to provide training to every employee authorized to perform lockout at the facility. Employees who service and maintain equipment such as the shavings bin that was equipped with an auger were exposed to caught in/caught by, entanglement and amputation hazards from rotating parts. On or about November 22, 2021, an untrained employee (Millwright by trade) was tasked with fabricating a cover for the shavings bin and auger which remained operational at the time of the incident. The employee was inadvertently pulled into the machinery resulting in a fatal incident.

29 CFR  1910.178(c)(2)(vii): One or more approved power-operated industrial trucks designated as DY, EE, or EX were not provided by the employer to be used in atmospheres in which combustible dust will not normally be in suspension in the air or will not be likely to be thrown into suspension by the normal operation of equipment or apparatus in quantities sufficient to produce explosive or ignitable mixtures but where deposits or accumulations of such dust may be ignited by arcs or sparks originating in the truck:  On or before November 23, 2021, the employer did not provide approved power-operated industrial trucks designated as DY, EE, or EX for use inside of the sawmill where wood dust was allowed to accumulate. Employees assigned, and/or who worked in the area were exposed to combustible and explosive hazards from Class II combustible wood dust.

29 CFR  1910.265(c)(23)(i):The employer did not ensure that the guarding for open bins, bunkers, and hoppers whose upper edges extend less than 3 feet above working level shall be equipped with standard handrails and toe boards, or have their tops covered by a substantial grill or grating with openings small enough to prevent a man from falling through:   a) Colorado Timber Resources, LLC at 210 Co Rd 21, Parshall, CO 80468. Guarding to protect employees from inadvertently contacting the auger (which rotated at 90 -100 RPMs) was not installed. Employees who get on top of the shavings bin equipped with auger to service the machinery were not protected from inadvertent/accidental contact with the moving/rotating parts. On November 22, 2021, an employee tasked with fabricating a cover for the opening (which was approximately 20 - 24 inches) on top of the shavings bin was fatally injured when he was pulled into the auger that was operational at the time of the incident.
