29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: 10 Sterling Way, North Oxford, MA: As of November 30, 2021 and at times prior, the employer had not instituted an energy control program to ensure outside maintenance contractors and the employer's employees were not exposed to the hazards of uncontrolled energy when performing maintenance and servicing on machines including but not limited to the main conveyor belt machine. There were no energy control procedures for multi-energy source machines. There was no training for all employees who entered areas where energy control was to be used to ensure they understood their responsibilities under the program. There had been no periodic inspections performed that ensured each procedure was inspected for inaccuracies during an actual energy control task. The employer also did not ensure that the inspector reviewed each authorized employee's responsibilities under each energy control procedure they were authorized to use.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: 10 Sterling Way, North Oxford, MA: As of November 30, 2021, the employer had not developed or documented any machine specific energy control procedures, including the multi energy source main conveyor machine. On November 23, 2021 and at times prior, employees who removed ice from the main conveyor weighted tensioning rollers only requested the control room apply a lock to the electrical disconnect switch, but did not apply and have control of their own lock. On November 23, 2021, an employee who was removing ice from the main conveyor weighted tensioning rollers while they were operating did not utilize any energy control procedure and was severely injured.
