29 CFR  1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  On November 29, 2021 and in months prior, 3302 Enterprise Road, Fort Pierce, FL 34982; the employer did not develop or implement a written respiratory protection program with worksite-specific procedures for employees who were required to wear Bandit Elastomeric Full Facepiece Disposable Dual Cartridge respirators while conducting boat sanding work activities.

The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On November 29, 2021 and in months prior, 3302 Enterprise Road, Fort Pierce, FL 34982; the employer did not provide medical evaluations for employees who were required to wear a Bandit Elastomeric Full Facepiece Disposable Dual Cartridge respirator while conducting boat sanding.

29 CFR  1910.134(f)(2):The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  On or about November 29, 2021, and in months prior, jobsite located at 3302 Enterprise Road, Fort Pierce, FL 34982; the employer did not provide fit testing prior to requiring  Bandit Elastomeric Full Facepiece Disposable Dual Cartridge respirator use to employees who wears while conducting work activities such as, but not limited to, boat sanding.

29 CFR  1910.1200(g)(1):  Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:   On or about November 29, 2021, and in months prior, the employer did not provide safety data sheets for the hazardous chemicals, such as but not limited to Mother's Mag and Aluminum Polish and Presta Strata Ultra Cutting Creme, in his workplace at 3302 Enterprise Road, Fort Pierce, FL 34982. This exposed employees to chemical hazards when polishing, sanding, and buffing.
