29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): Location: Worksite (Attic Area, Historic Bldg., Oxford School, 347 Main Street, Fairhaven, MA) Prior to workers entering an attic space to conduct HVAC work, the employer did not conduct adequate frequent and regular inspections of the area's construction to ensure the integrity of the construction of the floor. While conducting the HVAC work in the attic an inadequately covered floor hole board dislodged and caused a worker to fall 40-feet through a pipe chase and incurred serious injuries and was hospitalized.

29 CFR 1926.502(i)(2): All other covers were not capable of supporting, without failure, at least twice the weight of the employees, equipment, and materials that maybe be imposed on the cover at any one time. Location: Worksite (Attic Area, Historic Bldg., Oxford School, 347 Main Street, Fairhaven, MA: When workers were conducting HVAC work in an attic space, at least one floor covering did not support the weight of the worker who stepped onto it. The board failed and the worker fell approximately 40 feet through a pipe chase to the basement below, incurring severe injuries.

29 CFR 1926.502(i)(3): All covers were not secured when installed so as to prevent accidental displacement by the wind, equipment, or employees: Location: Worksite (Attic Area, Historic Bldg. Oxford School, 347 Main Street, Fairhaven, MA): When workers were conducting HVAC work, floorboards covering holes were not adequately secured to prevent displacement. When a worker stepped onto the inadequately secured floor covering at least one hole, the board dislodged from the substrate and caused the worker to fall 40 feet down through a pipe chase to the basement below. The worker incurred severe injuries that required hospitalization.
