29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) On or about November 29, 2021, and at times prior, the employer, N-Hance Wood Refinishing of Denver and Boulder, Inc., did not implement a written respiratory protection program detailing procedures for employees who are required to wear full-face respirators for hazardous substances including, but not limited to: N-Hance Cabinet Lightspeed, N-Hance Deep Tint Base, N-Hance Opaque Base. Employees were not: medically evaluated prior to use of a respirator; fit-tested prior to wearing tight-fitting respirators and annually thereafter; or trained on use, maintenance storage, and limitations of respirators.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) On or about November 29, 2021, and at times prior, N-Hance Wood Refinishing of Denver and Boulder, Inc., did not ensure employees were protected from skin irritation hazards while spraying Cabinet Lightspeed Plus, Deep Tint Base and Opaque base, which are all skin irritant mixtures. The employer had Tyvek suits on-site but did not require them to be worn during spraying operations.

29 CFR 1910.157(e)(1): The employer shall be responsible for the inspection, maintenance and testing of all portable fire extinguishers in the workplace: (a) On or about November 29, 2021, and at times prior, N-Hance Wood Refinishing of Denver and Boulder, Inc., did not ensure employees were not exposed to fire danger hazards due to a lack of fire extinguisher inspection. The last inspection date on one of the fire extinguishers was April, 2019.
