29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  Mingus Builders, LLC at the worksite located at 430 E. Market in Sandusky, Ohio: On or about December 1, 2021, the employer did not implement a plan or safety program to identify job site hazards for employees to maintain a safe working environment.  Such a program would allow the employer to identify potential hazards such as falls during job site operations, decreasing the probability of employee injury.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  Mingus Builders, LLC at the worksite located at 430 E. Market in Sandusky, Ohio: On or about December 1, 2021, the employer did not ensure employees were trained to recognize appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems or alternative measures.  Employees performing framing activities on a residential structure were exposed to fall hazards of up to approximately 13 feet.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  Mingus Builders, LLC at the worksite located at 430 E. Market in Sandusky, Ohio: On or about December 1, 2021, the employer did not ensure employees were protected from falls while performing framing work.  Employees working at the roof level to frame a residential structure were exposed to falls up to approximately 13 feet.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
