29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: a) Lot 10 of the Liberty Development Millsboro, DE 19966: On or about December 2, 2021, the employer failed to ensure subcontractor's employees used ladders for purposes in which they were designed. An 6 foot A-Frame ladder was used to gain access to the upper levels of the home that were at least 10 foot above the lower level, exposing employees to fall hazards approximately 10 feet above grade.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) Lot 10 of the Liberty Development Millsboro, DE 19966: On or about December 2, 2021, the employer failed to ensure subcontractor's employees did not use the top of the stepladder. The 6 foot A-frame ladder was used to access the upper landings of the home. Employees used the top step of the ladder to gain access to the upper landings by standing on top of the ladder and climbing onto the walls.
