29 CFR 1910.502(l)(5)(iii)(A):The employer did not pay the employee the same regular pay and benefits, up to $1,400 per week, until the employee met the return to work criteria specified in paragraph (l)(4)(iii) or (l)(6) of this section. Hillside Rehabilitation Hospital located at 8747 Squires Lane NE, Warren, OH 44484: On or about December 7, 2021 the employer failed to pay an employee working on the stroke rehabilitation unit (Center 1) their same regular pay, up to $1,400 per week, when they were removed from work in accordance with paragraph (l)(4) of this section. One Registered Nurse working on the Stroke Rehabilitation Unit (Center 1), was quarantined November 20 through November 22, 2021; hospitalized between November 23 through November 28, 2021; and subsequently quarantined on November 28 through December 10, 2021. The Registered Nurse was not paid for their originally scheduled work time on the following days: November 20, 21, 24, 27, 28 and December 3, 4, and 5.
