The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  At a worksite located at E1522 County Road Q in Waupaca, Wisconsin; the employer did not develop and implement a fall protection training program to enable employees that are exposed to fall hazards while sheathing a commercial roof to recognize the hazard of falling and the procedures to follow to minimize those hazards.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. 29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about December 2, 2021, at a worksite located at E1522 County Road Q in Waupaca, Wisconsin; the employer did not ensure that an employee engaged in sheathing a roof on a single-story commercial building had appropriate eye protection donned when potentially exposed to flying particles produced by a Milwaukee nail gun.   b) On or about December 2, 2021, at a worksite located at E1522 County Road Q in Waupaca, Wisconsin;  the employer did not ensure that an employee engaged in cutting plywood sheathing had appropriate eye protection donned when potentially exposed to flying particles produced by a Milwaukee circular saw.

29 CFR  1926.501(b)(2)(i): Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about December 2, 2021, at a worksite located at E1522 County Road Q in Waupaca, Wisconsin; employees constructing the leading edge of a single-story commercial construction roof were not protected from falling approximately 11 feet 8 inches off the unprotected edge and leading edge.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.

On or about December 2, 2021, at a worksite located at E1522 County Road Q in Waupaca, Wisconsin; while sheathing the roof of a 1-story commercial building, employees used an 8-foot, A-frame stepladder to access and egress the roof surface without the legs fully opened and spreaders locked.
