29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v): (a) On or about November 30, 2021, and at times prior, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by the hazard communication standard. Employees in the brew deck area were exposed to contact with chemical hazards in that two spray bottles containing Saniclean, a phosphoric acid solution, were not labeled. The phosphoric acid solution is used for cleaning purposes and is a known corrosive agent.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use: (a) On or about November 30, 2021, and at times prior, the employer did not have a safety data sheet for Saniclean, which is used to clean and disinfect brewing equipment. Saniclean contains phosphoric acid, a known corrosive agent readily available for employees. Exposure to phosphoric acid causes severe skin and eye irritation.
