Employees working below the roof's edge were not utilizing head protection which exposed them to struck-by hazards to the head.

Rigoberto Luis Santiago was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(1), which was contained in OSHA inspection number 1544301, citation number 1, item number 1 and was affirmed as a final order on September 14, 2021, with respect to a workplace located at 8544 East Main Street, Reynoldsburg, OH 43068.

The employer did not train and instruct employees on the hazards and regulations required to avoid and eliminate unsafe conditions such as, fall hazards and struck by hazards. Rigoberto Luis Santiago was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.21(b)(2), which was contained in OSHA inspection number 1530841, citation number 1, item number 2 and was affirmed as a final order on June 6, 2021, with respect to a workplace located at 6321 Dietz rd, Canal Winchester, OH 43110.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) Luis Cruz Construction LLC, at the jobsite located at 5290 Thorngate rd, Galloway, OH 43119: On and/or preceding December 2, 2021, the employer did not ensure employees were protected by fall protection systems while engaged in residential construction activities. Employees were engaged in roofing operations to an existing two-story single family house. The employees did not have any means of fall protection, thereby the exposed to fall hazards up to 13 feet. The Rigoberto Luis Santiago was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1530841, citation number 1, item number 4 and was affirmed as a final order on June 6, 2021, with respect to a workplace located at 6321 Dietz rd, Canal Winchester, OH 43110.

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) Luis Cruz Construction LLC, at the jobsite located at 5290 Thorngate rd, Galloway, OH 43119: On and/or preceding December 2, 2021, the employer did not ensure portable ladders that were used for access to an upper landing surface were extended at least 3 feet (.9m) above the upper landing surface. One extension ladder being used for access to the roof of the two-story residential home were position with the side rails extended less than 26 inches beyond the upper landing surface. The following condition exposed employees to falls up to 9 feet. Rigoberto Luis Santiago was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1544301, citation number 1, item number 4 and was affirmed as a final order on September 14, 2021, with respect to a workplace located at 8544 East Main Street, Reynoldsburg, Ohio 43068.
