29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Hebron Brick Supply Co. at 6506 Twin Pines Drive, Sioux Falls, SD 57110: On or about and at times prior to December 2, 2021, the exposing employer did not ensure that employees were protected from falls while conducting fireplace vent installation on the roof of a residential property. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.1053(b)(13):The top or top step of a stepladder was used as a step: (a)Hebron Brick Supple Co. at 6506 Twin Pines Drive, Sioux Falls, SD 57110: On or about and at times prior to December 2, 2021, the employer did not ensure that employees were utilizing ladders safely in that employees were accessing the top step of the ladder to gain access to and from the residential roof while installing fireplace vent pipe. This condition exposed employees to fall hazards while accessing the roof.
