29 CFR 1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) Abner Isidro Rojas Casalegno, at a jobsite located at 759 Peacock Drive, Lot 2098, Sunbury, Ohio 43074: On and/or preceding November 30, 2021, the employer failed to ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Employees were using pneumatic nail guns and circular saws while framing the house. The employees were not utilizing eye protection, thereby exposing employees to struck-by hazards to the eyes.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Abner Isidro Rojas Casalegno, at a jobsite located at 759 Peacock Drive, Lot 2098, Sunbury, Ohio 43074: On and/or preceding November 30, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. An employee was standing on the top plate of a wall while framing the second story, thereby exposed to fall hazards of up to 11 feet 9 inches. b) Abner Isidro Rojas Casalegno, at a jobsite located at 759 Peacock Drive, Lot 2098, Sunbury, Ohio 43074: On and/or preceding November 30, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employee were working next to an unguarded basement opening, thereby exposed to fall hazards of up to 9 feet 7 inches.

An employee was standing on the top plate of a wall while framing the second story and did not know when fall protection was required, thereby being exposed to an 11 foot, 9 inch fall hazard. b) Abner Isidro Rojas Casalegno, at a jobsite located at 759 Peacock Drive, Lot 2098, Sunbury, Ohio 43074: On and/or preceding November 30, 2021, the employer did not ensure employees were trained to recognize the hazards of falling and the procedures required to be followed in order to minimize the fall hazards.
