29 CFR 1910.28(b)(13)(i): The employer did not ensure that when work is performed less than 6 feet (1.6 m) from the roof edge, each employee is protected from falling by a guardrail system, safety net system, travel restraint system, or personal fall arrest system. (a) On or about December 3, 2021, at the worksite located at 310 W. Wisconsin Ave., Milwaukee, WI, the employer did not ensure fall protection was performed for personnel engaged in roof maintenance tasks including, but not limited to, the removal of moss and other vegetation on the skywalk, thereby exposing workers to fall hazards. ...In the Alternative... 29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) On or about December 3, 2021, at the worksite located at 310 W. The employer may use a designated area when performing work that is both infrequent and temporary. (a) On or about December 3, 2021, at the worksite located at 310 W. Wisconsin Ave., Milwaukee, WI, the employer did not ensure fall protection was performed for personnel engaged in roof maintenance tasks including, but not limited to, the removal of moss and other vegetation on the 11th floor roof, thereby exposing workers to fall hazards.
