OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazards:  a)  On or about  December 2, 2021, and times prior thereto, employees were exposed to a struck-by hazard due to loss of braking function on Podzilla lift system when offloading/loading from delivery truck and operating device on inclined surfaces.  b) On or about  December 2, 2021, and times prior thereto, employees were exposed to a struck-by hazard due to lack of inspection/preventative maintenance before using Podzilla lift system with worn and cracked tires.
