Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and of the availability of material safety data sheets, must also be addressed. 29 CFR  1926.150(a)(1):  The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and did not provide for the firefighting equipment as specified in this subpart:  a) Lot 10 of the Liberty Development Millsboro, DE 19966: On or about December 2, 2021, the employer did not develop and maintain any type of fire protection program to ensure that required fire protection was addressed and the employees knew what to do in the event of a fire. There was nothing on site where employees worked with flammable materials including but not limited to gasoline, wood, paper and other ignition sources were present including but not limited to heat and spark producing equipment, as well as compromised electrical components.

29 CFR 1926.503(a)(1): The employer did not train each employee who might be exposed to fall hazards to enable them to recognize fall hazards and the procedures to be followed in order to minimize these hazards:  a) Lot 10 of the Liberty Development Millsboro, DE 19966: On or about December 2, 2021, the employer did not train each employee exposed to a fall hazard to properly recognize and minimize fall hazards.  Abatement Note: The training program must enable the employees to recognize the hazards of falling and must train each employee in the procedures to be followed in order to minimize these hazards.  Each employee must be trained by a competent person in the following: 1. The nature of fall hazards in the work area; 2. The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3. The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 4. The role of each employee in the safety monitoring system when this system is used; 5. The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6. The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; 7. The role of employees in fall protection plans; 8. The standards contained in this subpart. The employer must verify compliance with paragraph (a) of this section by preparing a written certification record that will contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.

The 6 foot A-frame ladder was used to access the upper landings of the home. Employees used the top step of the ladder to gain access to the upper landings by standing on top of the ladder and climbing onto the walls.
