29 CFR  1926.651(c)(2):29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not utilized for work in trench excavations that are 4 feet (1.22 m) or more in depth:   a)  On or about 12/03/2021, at the future site of  a Starbucks Caf�, located at 650 Blossum Road in Rochester, New York, the employer did not enforce the use of a ladder for safe egress for employees working in a trench 8 feet below grade installing a grease trap.  NO ABATEMENT CERTIFICATION REQUIRED
