29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  On or about December 7, 2021 and times prior there to, the employer did not ensure employees engaged in residential construction at heights greater than six feet above the lower level were protected with some form of personal fall protection.

29 CFR  1926.1053(b)(1):Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  On or about December 7, 2021 and times prior there to, the employer did not ensure portable extension ladders being used by employees to access an upper landing (roof) extended at least three feet above the upper landing surface.

29 CFR  1926.1053(a)(2):Ladder rungs, cleats, and/or steps were not parallel, level, and uniformly spaced when the ladder was in position for use.  On or about December 7, 2021 and times prior there to, the employer did not ensure a portable ladder used by employees to access the roof was positioned in such a way that the cleats were uniform and level to the ground during use of ladder.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.  On or about December 7, 2021 and times prior thereto, the employer did not provide documentation to substantiate the existence of a training program for employees that used ladders as required by job duties and would enable the employees to recognize hazards and how to mitigate hazards associated with ladder usage.
