29 CFR 1926.1431(a): The use of equipment to hoist employees was not prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the projects structural design or worksite conditions:  (a)	R.G. Brinkmann Company DBA Brinkmann Constructors at 1122 North Albion Street, Denver, CO 80220: On and before December 7, 2021, on multiple occasions the employer allowed two subcontractor workers to access and ride a MEVA Climbing Scaffold KLK 230 while it was hoisted into position by a Link-Belt HTC-8675, 75-ton Telescoping Boom Crane.  This condition exposed subcontractor employees to struck-by hazards as well as fall hazards ranging from approximately 10 feet to 65 feet.  (b)	R.G. Brinkmann Company DBA Brinkmann Constructors at 1122 North Albion Street, Denver, CO 80220: On December 7, 2021, the employer allowed two subcontractor workers to access and ride a MEVA Climbing Scaffold KLK 230 while it was hoisted into position by a Link-Belt HTC-8675, 75-ton Telescoping Boom Crane.  The scaffold system shifted and inverted while it was being hoisted by the crane thus injuring both workers.  One worker was seriously injured after he fell approximately 65 feet and contacted the ground.  The other worker struck formwork that his fall protection system was attached to.  This condition exposed subcontractor employees to struck-by hazards as well as fall hazards ranging from approximately 10 feet to 65 feet.
