29 CFR 1926.1431(a): The use of equipment to hoist employees was not prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the projects structural design or worksite conditions: (a) B & C STEEL INCORPORATED at 1122 North Albion Street, Denver, CO 80220: On and before December 7, 2021, the employer operated a Link-Belt HTC-8675, 75-ton Telescoping Boom Crane to hoist a MEVA Climbing Scaffold KLK 230 while two workers from another company accessed and rode the equipment. This condition exposed workers from another company to struck-by hazards as well as fall hazards ranging from approximately 10 feet to 65 feet. (b) B & C STEEL INCORPORATED at 1122 North Albion Street, Denver, CO 80220: On and before December 7, 2021, the employer operated a Link-Belt HTC-8675, 75-ton Telescoping Boom Crane to hoist a MEVA Climbing Scaffold KLK 230 while two workers from another company accessed and rode the equipment. The scaffold system shifted and inverted while it was being hoisted by the crane thus injuring both workers. One worker was seriously injured after he fell approximately 65 feet and contacted the ground. The other worker struck formwork that his fall protection system was attached to. This condition exposed workers from another company to struck-by hazards as well as fall hazards ranging from approximately 10 feet to 65 feet.
