29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about December 8, 2021 at the 106 North Street Construction Project, employees were installing roof joists and no fall protection system was in use.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. On or about December 8, 2021 at the 106 North Street Construction Project, employees were using an aluminum multi position ladder in the extension ladder position to access the upper deck. The ladder at its' location could not be extended 3 feet past the roof deck and the ladder was not secured and no grab handle was provided or in use.
