29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about December 9, 2021, at a commercial jobsite, an employee worked without head protection on the ground below roofing employees working from above. The employee was exposed to overhead struck-by hazards.

29 CFR  1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about December 9, 2021, and at times prior thereto, at a commercial roofing jobsite, the employer did not provide employees with fall protection. Roofing employees were exposed to fall hazards greater than six feet to the ground and concrete below.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about December 9, 2021, and at times prior thereto, at a commercial roofing jobsite, the employer did not ensure the ladder used to access and egress the roof extended three feet above the roofs edge.  Employees were exposed to fall hazards to the ground and concrete below.

29 CFR  1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:   Note:  Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or (3) changes in the type of fall protection systems or equipment to be used; or (4) Inadequacies in an affected employees knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill:   On or about December 9, 2021, and at times prior thereto, at a commercial roofing jobsite, the employees understood and retained the knowledge and or skills to prevent fall hazard and exposure to fall hazards where the employees were working over 6 feet and exposed to fall hazards.

On or about December 9, 2021, and at times prior thereto, at a commercial roofing jobsite, the employer did not ensure the employees were provided ladder safety program to understand and avoid ladder hazards and fall hazards when used to access and egress the roof extended three feet above the roofs edge.
