29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: On or about December 6, 2021, at a jobsite located at 4105 Live Oaks Road, The Colony, Texas 75056; where at least one (1) employee operated a powered industrial trucks and their previous certification had expired or was not valid and where each employee authorized to operate power industrial trucks were not re-trained or re-evaluated; a) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely, b) where the operator is assigned to drive a different type of truck, or c) where a condition in the workplace changes in a manner that could affect safe operation of the truck was not provided required power industrial truck training.
