29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a)  Good's Installation Services, at a jobsite located at 55 N West street, Westerville, OH 43081: On and/or preceding December 10, 2021, employees were engaged in residential construction activities to an existing two-story single family house. The employer failed to maintain a safety and health program such as but not limited to a fall protection program and ladder safety program to ensure detection and correction of hazards during roofing activities.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Good's Installation Services, at a jobsite located at 55 N West st. Westerville, OH 43081: On and/or preceding December 10, 2021, the employer did not ensure employees were protected from falls while engaged in residential roofing construction activities. Employees were installing gutters to an existing two-story single family house. The employees did not have any means of fall protection, thereby exposed to fall hazards up to 9 feet 4 inches.

Two employees were engaged in residential roofing activities while on a 28 foot aluminum extension ladder. The employees combined weight exceeded the manufacturer's rated load capacity of 375-pounds.

29 CFR  1926.1053(b)(4):Ladders shall be used only for the purpose for which they were designed.  b) Good's Installation Services, at a jobsite located at 55 N West street, Westerville, OH 43081: On and/or preceding December 10, 2021, the employer did not ensure ladders were for the purpose for which they were designed. Two employees were engaged in residential roofing construction activities while on a 28 foot aluminum extension ladder. The employees positioned the extension ladder over the porch roof and against the second-story exterior of the house.  An employee was standing on the top rungs of the extension ladder while one employee used his body weight on the bottom rungs to prevent displacement of the extension ladder, thereby exposing the employee to a 9 foot 4 inch fall hazard.

29 CFR  1926.1053(b)(5)(i):Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  c) Good's Installation Services, at a jobsite located at 55 N West street, Westerville, OH 43081: On and/or preceding December 10, 2021, the employer did not ensure non-self-supporting ladders were used in a safe manner, in that, the angle of use exceeded the horizontal distance required by this part. A 28 foot Werner extension ladder was used as access to the second-story to perform gutter installation. The ladder was used in an unsafe manner, in that, the angle of use exceeded the horizontal distance required by this part. The horizontal distance from the top support to the foot of the ladder was 25 feet and the working length of the ladder was approximately 32 feet; exceeding 6 feet which is one-quarter the working length of the ladder, thereby exposing the employee to a 20 foot fall hazard.
