29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:                a)  At 210 Monroe Avenue, Watertown, NY 13601:  An employee was permitted to perform outdoor concrete cutting operations with a handheld angle grinder without using a  shroud and dust collection system nor an integrated water delivery system that continuously feeds water to the blade as a control in Table 1.

The worker's task included use of a handheld angle grinder without a shroud and dust collection system nor an integrated water delivery system.

29 CFR  1926.1153(i)(2)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of at least the requirements outlined in 29 CFR 1926.1153(i)(2)(i)(A) through (F) where there was exposure to respirable crystalline silica:   a) At 210 Monroe Avenue, Watertown, NY 13601, on or about 12/9/2021: The employer did not train each affected worker to understand silica hazards and measures of protection when working with silica.  The lack of training resulted in an employee performing outdoor concrete cutting operations with a handheld angle grinder without a shroud and dust collection system nor an integrated water delivery system, while exposed to silica.
