29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On or about December 9, 2021, at the job site employees were not in use of a protective helmet when working in an excavation in areas were heavy machinery and objects where located above. This exposed the employees to struck-by hazards.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees. On or about December 9, 2021, at the jobsite employees were observed working in an excavation that was more than four(4) feet without a safe means to egress. This exposed the employees to a fall hazard and caught in hazard when egressing the excavation.

29 CFR 1926.651(l): Guardrails complying with 1926.502(b) were not provided where walkways were 6 feet (1.8m) or more above lower levels. On or about December 9, 2021, at the job site,employees were observed crossing over an excavation that was more than six feet deep by walking on a wood plank that was laid over the excavation. There were no guardrails installed on this walkway and this exposed the employees to a fall hazard.
