29 CFR 1910.134(a)(2): The employer did not provide appropriate respirators when necessary to protect employee health: a)Aspen Dental located at 9898 East Roosevelt Boulevard Philadelphia PA: On or about December 13, 2021, employees conducting dental procedures involving aerosol-generating procedures were not provided with NIOSH-certified respirators for protection against aerosolized SARS-CoV-2 virus. At a minimum, a N95 NIOSH-certified filtering facepiece respirator was not provided to protect employees from aerosolized SARS-CoV-2 virus.

The employer required employees to wear N95 or KN95 respirators such as but not limited to N95 Moldex (ProGear, 200 Series), YIKE (YK-KN95) and Mocue (KN95 GB2626-2006) while providing dental care to suspected COVID-19 patients.
