OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: struck by hazard. This violation occurred on or about December 11, 2021, when employees working in the railyard switching and moving railcars were exposed to struck- by moving railcars. Pursuant to 29 CFR 1903.19, within ten calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is takes to ensure employees have on a visibility safety vest when exposed to struck-by hazards.
