29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:    On or about December 10, 2021, employer did not enforce the use of a fall protection system when employee was installing solar panels on a residential roof. This condition exposed employees to fall hazards greater than 6-feet to the ground below.  Marc Jones Construction LLC DBA SunPro Solar, was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1489121 citation number 2, item number 1  and was affirmed as a final order on January 28, 2021 at a workplace located at 6906 Hibiscus Falls, San Antonio, TX 78218.  Marc Jones Construction LLC DBA SunPro Solar, was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1461427 citation number 1, item number 1  and was affirmed as a final order on April 23, 2020 at a workplace located at 10432 Aphrodite, El Paso, TX 79924.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.      Residential roof: On or about December 10, 2021, the employer did not ensure that employees working on a single story residential roof retained the requisite understanding or skill for safe work practice. This condition exposed employees to fall hazards greater than 6-feet to the ground below.  Marc Jones Construction LLC, was previously cited for a violation of this Occupational Safety and Health Standard or it equivalent standard 1926.503(a)(2), which was contained in OSHA inspection number 1489121 citation number 1, item number 1  and was affirmed as a final order on January 28, 2021 at a workplace located at 6906 Hibiscus Falls,  San Antonio, TX 78218.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  On or about December 10, 2021 or, within twenty-four (24) hours after the in-patient hospitalization employer did not report the hospitalization of an employee.
