29 CFR 1910.134(f)(1): The employer did not ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph. a) Workplace, 143 Meadows Road, Lafayette, NJ The employer provided and required employees including Youth Support Specialists and Therapists to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 during the care and supervision of Covid-19 Positive or Under Investigation Youth Residents. The employer did not ensure that a Youth Support Specialist and a Therapist passed a Qualitative or Quantitative fit test; the employees failed a fit test on 12-14-21, but continued to wear the respirator on which they had failed the fit test. Violation occurred on or about December 14, 2021 and thereafter.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) Workplace, 143 Meadows Road, Lafayette, NJ The employer provided and required employees including Youth Support Specialists and a House Manager to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 during the care and supervision of Covid-19 Positive or Under Investigation Youth Residents. The employer did not ensure that initial fit testing was conducted for a Youth Support Specialist, and a House Manager. Violation occurred on or about December 12, 2021 and thereafter.
