Located at 1301 Columbus Pike, Delaware, Ohio: On or about December 15, 2021, and at times prior, the employer did not initiate and maintain safety and health programs such as, but not limited to, fall protection, ladder safety, personal protective equipment, power tool safety, and scaffold safety. Employees were thereby exposed to struck-by and fall hazards.

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:  a. Located at 1301 Columbus Pike, Delaware, Ohio: On or about December 15, 2021, and at times prior, the platform utilized as a working level on the Biljax mobile scaffold platform was not fully planked or decked, thereby exposing employees to falls of approximately 14 feet - 5 inches, to the concrete surface below.

Located at 1301 Columbus Pike, Delaware, Ohio: On or about December 15, 2021, and at times prior, employees utilized a Biljax mobile scaffold to access the roof and perform various activities without conducting inspections of the scaffold and its components prior to use.

29 CFR  1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  a. Located at 1301 Columbus Pike, Delaware, Ohio: On or about December 15, 2021, and at times prior, employees were performing work on the flat roof to enclose HVAC units without utilizing any fall protection measures. As a result, employees were exposed to falls from a height of approximately 18 feet - 2 inches.  b. Located at 1301 Columbus Pike, Delaware, Ohio: On or about December 13, 2021, and at times prior, employees were performing work at the edge of the flat roof to install roofing caps on the corners of the building without utilizing any fall protection measures. As a result, employees were exposed to falls from a height of approximately 18 feet - 2 inches.
