29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), & (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes items (i) and (ii) of this subparagraph: a) NKS Distributors site at 63 Big Woods Road Smyrna, DE 19977: On or about December 16, 2021, the employer did not provide or maintain a hazardous communication program to include labels and other forms of warning, safety data sheets, and employee information and training as required. It was stated at the site that the program is on line. However, according to the provided documents received after the document request the program is maintained in the company and nothing is stated as far as being electronic. Furthermore, the Foreman, Competent Person and Employee could access or describe how to access the required information. ABATEMENT NOTE: A written program shall include description of how the criteria for the following will be met: 1. Labeling and other forms of warning; 2. Material Safety Data Sheets; 3. Employee information and training Additionally, a list of hazardous chemicals known to be preset in the workplace must be compiled. Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and of the availability of material safety data sheets, must also be addressed. The written program must be made available upon request.

This created a potential struck by hazard in the event of material was to fall into the excavation/trench.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. a) NKS Distributors site at 63 Big Woods Road Smyrna, DE 19977: On or about December 16, 2021, the employer failed to remove employees from an excavation/trench where water was accumulating and continued to come out of the walls of the excavation/trench. There was a pit with a pump but it could not keep up with the flow of water and/or not in use.
