29 CFR  1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall:  29 CFR  1926.502(d)(16)(iii):be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level.  a) Miguel A Rojas Ramirez, at a jobsite located at Lot 299 at Ellington Village, Granville, Ohio 43023: On and/or preceding December 14, 2021, the employer failed to ensure a vertical lifeline was rigged so that employees were protected from falls no more than six feet. An employee was sheathing the roof of a house where the lifeline was extended to the end of the rope, thereby exposing the employee to a fall of 12 feet.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Miguel A Rojas Ramirez, at a jobsite located at Lot 299 at Ellington Village, Granville, Ohio 43023: On and/or preceding December 14, 2021, the employer failed to initiate and maintain a safety and health program such as but not limited to an electrical safety program and a compliant fall protection program for employees conducting framing work.  Rojas Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1481700, citation number 2, item number 1 and was affirmed as a final order on August 8, 2020, with respect to a workplace located at Woodland Sky Drive, Lot 123, PATASKALA, OH, 43062.  Miguel Ramirez, the owner of Rojas Brother Construction LLC, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1378451, citation number 2 item number 1 and was affirmed as a final order on March 26, 2019, with respect to a workplace located at 7267 Monarch Street, Canal Winchester, OH 43110.

Rojas Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1481700, citation number 2, item number 2 and was affirmed as a final order on August 8, 2020, with respect to a workplace located at Woodland Sky Drive, Lot 123, PATASKALA, OH, 43062. 29 CFR  1926.404(b)(1)(iii)(C):Each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, shall be visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage. Equipment found damaged or defective shall not be used until repaired.  a) Miguel A Rojas Ramirez, at a jobsite located at Lot 299 at Ellington Village, Granville, Ohio 43023: On and/or preceding December 14, 2021, the employer failed to ensure employees were protected from electrical contact while engaged in residential construction activities by inspecting cords and equipment connected by cords before each day's use. Employees were using damaged cords, thereby exposing employees to 125 volt electrical contact hazards.  Rojas Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1481700, citation number 1, item number 1 and was affirmed as a final order on August 8, 2020, with respect to a workplace located at Woodland Sky Drive, Lot 123, PATASKALA, OH, 43062.

Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  a) Miguel A Rojas Ramirez, at a jobsite located at Lot 299 at Ellington Village, Granville, Ohio 43023: On and/or preceding December 14, 2021, the employer failed to ensure strain relief was provided to cords so that the pull was not directly transmitted to joints or terminal screws. Employees used an extension cord where the plugs of the cord had separated from the jacket of the cord, thereby exposing employees to a 122 volt electrical contact hazard.  b) Miguel A Rojas Ramirez, at a jobsite located at Lot 299 at Ellington Village, Granville, Ohio 43023: On and/or preceding December 14, 2021, the employer failed to ensure strain relief was provided to cords so that the pull was not directly transmitted to joints or terminal screws. Employees used a circular saw where the plug had separated from the jacket of the cord, thereby exposing employees to a 122 volt electrical contact hazard.  Rojas Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1481700, citation number 1, item number 3 and was affirmed as a final order on August 8, 2020, with respect to a workplace located at Woodland Sky Drive, Lot 123, PATASKALA, OH, 43062.
