29 CFR  1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  a) At the facility,  133 William Donnelly Industrial Park, Waverly, NY.  On or about 12/14/2021, Energy Control Procedures were not developed for machinery with multiple energy sources and/or for equipment with potential stored energy including, but not limited to, the Ingersoll-Rand, IRN50-200H-CC compressor. The IRN50-200H-CC runs on electrical and pneumatic energy.    Abatement certification must be submitted for this item.

29 CFR  1910.1053(h)(1):The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica unless wet sweeping, HEPA-filtered vacuuming or other methods that minimize the likelihood of exposure were feasible:  a) At the facility, 133 William Donnelly Industrial Parkway, Waverly, NY - Corian Area. On or about 12/14/2021,  employee(s) used a broom to dry sweep the floor containing silica dust/debris. Such activity could contribute to employee exposure to respirable crystalline silica.  Abatement certification must be submitted for this item

On or about 12/14/2021, employees work with and cut silica containing materials including, but not limited to Zodiac Quartz, Spectrum Quartz, and granite  as well as dry sweep silica containing dust and debris. The employees were not trained on silica in accordance with the provisions of Hazard Communication and paragraph (j)(3) of this section.  Abatement certification must be submitted for this item

29 CFR  1910.1053(j)(3)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the following: (A) the health hazards associated with exposure to respirable crystalline silica; (B) specific tasks in the workplace that could result in exposure to respirable crystalline silica; (C) specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used; (D) the contents of this section; and, (E) the purpose and a description of the medical surveillance program required by paragraph (i) of this section:   a) At the facility, 133 William Donnelly Industrial Parkway, Waverly, NY. On or about 12/14/2021, employees throughout the facility could not demonstrate knowledge and understanding of specific tasks in the workplace that could result in exposure to respirable crystalline silica including, but not limited to, dry sweeping silica containing dust and debris, and on the contents of the Respirable Crystalline Silica Standard, 29 CFR 1910.1053.  Abatement certification must be submitted for this item
