29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:   a) On or about December 16, 2021, employees were provided with and used an unguarded Bosch angle grinder while performing balcony restoration work.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or the basket when working from an aerial lift:   Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system:   a) On December 16, 2021, employees were exposed to the hazard of falling up to approximately 30 feet while working from the Genie aerial lift platform.   No abatement certification or documentation is required for this item.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:   a) On or about December 16, 2021, employer did not provide training to each employee in order to recognize hazards associated with working from aerial lifts and to understand procedures to control or minimize those hazards.
